Dual Enrollment Update

In February of 2025, PFF demanded to bargain over Dual Enrollment. Dual Enrollment had started in 2017 with MOUs that ensured the contract would be followed, so no additional negotiating would be necessary. However, after repeated concerns around dual enrollment, it was apparent we needed to have stronger language in the contract to protect faculty working conditions as we grow our dual enrollment partnerships. This was met with hesitation from the District until one particular situation escalated to a grievance, and we were finally able to make some progress and agree on an MOU for Dual Enrollment. The goal is to include this MOU as a new article in our next contract.
Initially, we had hoped to reach an agreement that established clear dual enrollment parameters and included a stipend to support faculty who take on this work. However, the District made the stipend contingent on faculty waiving their existing right under AP 5011 to approve or deny enrollment of minors under age 16 in their classes. PFF was not willing to bargain away that faculty right, so we were only able to reach agreement on dual enrollment parameters at this time.
Highlights:
There is language in this MOU that ensures specific areas of the contract are followed for Dual Enrollment classes. Though it might be repetitive, it is helpful for those teaching Dual Enrollment courses to see all the protections and agreements in one place. You’ll see reminders about attendance, maximum class size, evaluations, academic freedom, etc.
Site Onboarding & Orientation - faculty will now be compensated two hours at their noninstructional rate for site onboarding when they are assigned to an in-person Dual Enrollment course for the first time.
Travel time - scheduling considerations will be made to ensure faculty have enough time to travel from one site to another. Courses at separate worksites should be scheduled with at least one hour of travel time.
Tethered teaching - this MOU outlines faculty purview, expectations for assignments with a tethered teacher, and protocol in case there are concerns with the tethered teacher.
Criteria codes - there is a reminder in the MOU that departments can create criteria codes in their bylaws to prioritize Dual Enrollment assignments for faculty with specific training and/or experience.
Textbook selection - given that high schools often provide textbooks for the students in dual enrollment, it was negotiated that, when practicable, departments would maintain the same textbook for a course for the length of the CCAP agreement or use OER/ZTC material.
Student progress & behavior - it is important to note that student progress and behavior cannot be shared without instructor permission, to the extent provided by law.
Dual Enrollment Assignment Notice - faculty will receive an assignment notice outlining the details of the class including any variation to the Palomar calendar. For example, some faculty learned well into the semester that there were significant changes to the schedule that hadn’t been disclosed before the semester began. This language is an attempt to resolve those issues.
