Negotiations Update 29 September 2026
The agenda continues to show improved preparation and commitment from the District. Much of our work today involved cleaning up final counterproposals with some important wins in AI protections and expanded PD opportunities.
✅ Article 11 (Personnel Files) - District Counterproposal #1
In April, PFF presented our initial proposal for Article 11 to include language in the event that a dean is unavailable to complete the work associated with 11.3 as well as language for notifying faculty of Public Records Act requests. The District agreed to the majority of our proposal with some minor adjustments to the notification process. Given the current climate, this is an important win that will provide more transparency and ensure impacted faculty are notified whenever a PRA request is made.
✅ Article 25 (Intellectual Property) - District Counterproposal #2
PFF is very excited to see important updates to Article 25 to keep up with changes in technology. We were able to agree to language to protect faculty ownership rights when using District-provided AI tools, clarify that standard technology and software does not constitute “substantial support” that would affect ownership, and ensure that faculty-created works cannot be used to train, improve, test, or develop AI systems without the faculty member’s prior written consent. Our focus was on ensuring that the increasing use of AI won’t undermine faculty intellectual property rights.
📌 Article 28 (Dual Enrollment) - District Counterproposal #1
The District agreed to our proposal to create a new article using the language from our most recent MOU on Dual Enrollment, which is a big step in the right direction. The District countered by removing the language around minors and AP 5011 saying that the AP was enough.
PFF was able to counter after caucusing with our first counterproposal. We modified the language slightly to reference the AP, but we emphasized that there needed to be language around what to do with minors in the classroom. The District was not prepared to counter.
📌 Article 5 (Nondiscrimination) - PFF Initial Proposal
Based on listening sessions and updated nondiscrimination articles in other CBAs, we gave a proposal with stronger language around protected categories and introduced new categories to be considered as well, including a section around chosen names.
✅ Article 27 (Resignation) - PFF Counterproposal #2
After some back and forth, we were able to agree on extending the grace period to rescind a resignation to 72 hours (exclusive of Saturdays, Sundays, and holidays).
✅ Article 10 (Professional Development) PFF Counterproposal #1
In the past, part-time faculty were required to report professional development hours by May 1 or December 1 depending on the semester, which meant that any PD conducted during the last 3-4 weeks of the semester would not be eligible for PD pay. We were able to agree on language that allows this window to open up so that part-time faculty can engage in professional development year round and give the PD committee ample time to review and process the submissions. We were also able to agree on language for part-time faculty in reassigned time positions to be eligible for paid professional development hours. Now, all part-time faculty are eligible for up to 14.07 hours (67% of full-time requirements) of professional development pay regardless of whether they are teaching or on reassigned time.
✅ MOU_Work Based Learning AY 27-28 PFF Counterproposal #1
We were able to agree on an extension to our grant-funded Work-Based Learning Coordinator position.
📌 MOU_DRC Chair Extension for Spring 2027
We began a pilot DRC chair position in the Spring of 2024 and continue to advocate for this position to be codified in the contract. In the meantime, we proposed yet another extension to ensure continuity for the Spring 2027 semester.
Discussion
Prep for Assistant Instructor negotiations - We continue to gather feedback on the impacts of a new tier of faculty. Given the time concerns, we asked that the District discuss the situation and our supposal with the board at the October board meeting so that we can be ready to negotiate on October 20th.
Chair Stipend Error Updates - We reminded the District of our request to review the chair stipend errors made in the contract. The District assured us that it is a typo and all stipends were paid out accordingly, but they committed to bringing verification.
Grades Data - When the District shared they wanted to move the Fall semester earlier by one week, we asked what problem this change would fix. The District shared that there are too many faculty members submitting grades late and it is negatively impacting students’ ability to make decisions for the Spring semester. We submitted an information request on 8/17/26 for data related to late grades and have yet to receive a complete response.
Calendar Discussion - PFF reiterated that we can’t discuss the proposed 28-29 calendar until we have the complete data we requested on 8/17/26
